Anti-Spam Policy

The CAN-SPAM Act of 2003 came into effect on January 1, 2004. In the past there was much nonsense bandied about regarding “SPAM” We were pleased when the government laid out guidelines as to what legitimate commercial email is, and what is not. It is our strong desire to ensure full compliance with the spirit and letter of our government’s actions. We present the following document as our Anti-Spam Policy:
We intend to comply with each point as follows:

1. We will not transmit a message that has header information that is technically accurate but includes an originating electronic mail address, domain name, or Internet Protocol the access to which was obtained by means of false or fraudulent pretenses or representations.

2. We shall use a “from” line that accurately identifies the Advertiser, or any other party responsible for originating or transmitting a commercial electronic mail message.

3. We shall not knowingly initiate any commercial electronic mail message with misleading header information, because we require that any such message accurately identify the computer used to initiate the message.

4. We will not initiate the transmission of a commercial electronic mail message if it has actual knowledge, or knowledge fairly implied on the basis of objective circumstances, that a subject heading of the message would be likely to mislead a recipient about an important fact regarding the contents or subject matter of the message.

5. We will provide a clear and conspicuous “opt-out” or “unsubscribe” mechanism that a recipient may use to submit an Internet-based request not to receive future commercial electronic mail messages from any party whose product, service, or website is advertised or promoted by the message.

6. We will not assist in the origination of a message to an address if it has actual knowledge, or knowledge fairly implied on the basis of objective circumstances, that the electronic mail address of the recipient was obtained using an automated means from an Internet website or proprietary online service operated by another person, and such website or online service included, at the time the address was obtained, a notice stating that the operator of such website or online service will not give, sell, or otherwise transfer the address maintained by such website or online service to any other party for the purposes of initiating, or enabling others to initiate, electronic mail messages; or the electronic mail address of the recipient was obtained using an automated means that generates possible electronic mail addresses by combining names, letters, or numbers into numerous permutations.

7. We are not in the business of initiating transmission of electronic mail containing sexually oriented material.

The CAN-SPAM Act of 2003 also explicitly forbids various fraudulent practices that we have never endorsed or willingly been a party to. While it is unlikely that any of our customers have engaged in any of these practices, our compliance efforts require that we reiterate the fact that we expressly forbid broadcasting media affiliates to transmit any email message on behalf of a customer that:

1. uses scripts or other automated means to register for multiple electronic mail accounts or online user accounts from which to transmit, or enable another person to transmit any email or knowingly use any relay or retransmission of an email from a computer or computer network that has been accessed without authorization.

2. uses any computer without authorization, or intentionally initiates the transmission of multiple commercial electronic mail messages from or through such a computer.

3. uses a computer to relay or retransmit multiple commercial electronic mail messages, with the intent to deceive or mislead recipients, or any Internet access service, as to the origin of such messages

4. is accomplished through the intentional transmission from any electronic mail addresses or online user accounts, the registration of which were obtained using information that materially falsifies the identity of the actual registrant.

5. is accomplished through the intentional transmission from any Internet Protocol address, the access to which was obtained through a media affiliate’s false representation of itself to be the registrant or the legitimate successor in interest to the registrant of such Internet Protocol addresses; 6. uses any falsified or forged electronic mail transmission information or other routing information in any manner.
